Terms of Service
This document is available in English and Italian (switch with the IT/EN links at the top). If the two versions differ, the English version prevails. Last updated: 14 October 2026.
1. Who we are and what this covers
AI Album Studio ("the Service") is provided by AIAS di Del Mutolo Nicola ("we", "us"), VAT number IT02775620467, registered address at Via Ronco 36, Massarosa (LU), Italy. These Terms govern your access to and use of the Service, including your online account and any packages or credits you purchase. By registering an account or using the Service, you agree to these Terms.
Your right to install and use the desktop software itself, including license restrictions specific to the software, is governed by a separate End User License Agreement (EULA), which you are also asked to accept at first launch of the software (and during installation on Windows). Both documents apply together; see the EULA for how the two relate where they overlap.
2. The Service
AI Album Studio is a desktop application for professional photographers that uses artificial intelligence to help select photos and design and lay out photo albums. It works with photos in JPG format or, through the included plugin, directly with Adobe Lightroom Classic; Lightroom is not required. Some features require an active internet connection to a license-verification server operated by us. To use the software you need an account and a valid license (free trial or paid package): what happens at the end of the trial and when a package expires is set out in sections 3 and 4.
The system requirements (operating system and type of computer) are listed on the download page of the website. We encourage you to use the free trial to check that the software works on your computer before purchasing a package.
3. Free trial
New accounts start with a free trial, limited in duration, in the number of AI projects and in the number of styles; the limits of your trial are shown in the software (Settings, License section). During the trial, the albums you create cannot be exported: they become exportable once you purchase a paid package. No payment is required to start a trial, and no payment details are collected until you choose to purchase a paid package. We may change the length or limits of future trials at our discretion; this does not affect a trial already in progress.
At the end of the trial, if you do not purchase a package, the software can no longer be used: at the next launch you are asked to log in, and logging in is only possible after purchasing a package. The albums and projects you created stay on your computer and are not deleted by us; the Styles you created remain linked to your account. If you purchase a package with the same account, you get everything back and can also export the albums created during the trial.
4. Paid packages and pricing
Paid packages are described with their price, in Euro, on the package selection page at the time of purchase. Prices shown are annual and exclude VAT. Italian VAT (22%) is added at checkout for customers in Italy and for private customers in the European Union. No VAT is charged to businesses that provide a VAT number from another EU member state, valid on the EU VIES system at the time of purchase (reverse charge: the customer accounts for VAT in its own country), or to customers outside the European Union. The total, including any VAT, is shown before payment, and the invoice shows the taxable amount and any VAT separately. A package is billed as a single annual payment and gives you access for 365 days; renewal is manual, and we never charge your card automatically. We may change package pricing or composition for future purchases at any time; a package you have already purchased keeps the terms it was purchased under until its next renewal. The renewal price is the one in effect at the time of renewal and is shown to you before payment.
AI-Generated Albums. Each package includes a yearly number of albums generated with AI (unlimited in the Studio package). An album is counted only once, when it is generated; if you correct the chapters of an album already generated and generate it again, the album is replaced without using up another one. Manual layout does not use up albums.
Renewal. Renewal is possible during the last 60 days before expiry or after expiry. The new 365-day period starts from the previous expiry date, if it has not passed yet, otherwise from the day of renewal. On renewal, the number of AI albums is reset to your package's yearly allowance: albums not used in the previous year do not carry over.
Changing package. You can switch to a different package at any time. The new package runs for 365 days from the day of purchase, and its allowances (AI albums, Styles, workstations, included features) replace those of the previous package: remaining days, albums and additional Styles do not carry over to the new package, and no refund or pro-rata credit is given for the unused period of the previous package. The purchase page reminds you of this before payment.
Additional Styles and services. Additional Styles purchased separately are added to your current package and remain available after renewing the same package, but they do not transfer if you change package. Additional services that cannot be purchased on the website (for example AI Resizing and Online Preview for packages that do not include them) are activated on request, at the price and on the terms shown on the website at the time of the request.
On expiry. If a paid package expires and you do not renew it, AI album generation stops, while manual layout and the albums already created remain usable, including exporting them. Software updates are included for the duration of the package.
5. Payment
Payments are processed by Stripe, an independent third-party payment provider. We never see or store your full card details. By making a purchase, you also agree to Stripe's own terms of service. A purchase is confirmed once payment has been successfully processed.
6. Right of withdrawal and legal guarantee (consumers)
If you are a consumer located in the European Union or the United Kingdom, you generally have the right to withdraw from a purchase within 14 days without giving any reason, under EU Directive 2011/83/EU (or the equivalent UK regulations). Because AI Album Studio is digital content, this right ends earlier if you expressly ask us to start providing the paid package immediately and acknowledge that doing so makes you lose the withdrawal right — which the purchase form asks you to confirm at checkout if you are buying as a private individual. The right of withdrawal does not apply to purchases made for business or professional purposes (buyers purchasing as a business or professional, usually by providing a VAT number). Since every account already includes a free trial before any payment is made, you're able to evaluate the Service before you buy. To exercise your withdrawal right where it still applies, contact us at the address in section 16.
If you are located outside the EU/UK, statutory withdrawal rights may not apply, and refunds are handled at our discretion unless your local law requires otherwise.
If you are a consumer, you are also entitled to the legal guarantee of conformity for digital content and digital services (EU Directive 2019/770; in Italy, articles 135-octies and following of the Consumer Code). Nothing in these Terms or in the EULA excludes or limits this guarantee. To report a lack of conformity, contact us at the address in section 16.
7. License grant and software updates
Subject to these Terms and an active, paid or trial license, we grant you a license to install and use the desktop software on the number of workstations included in your package, under the terms of our End User License Agreement (EULA), which sets out the full license grant and restrictions (including restrictions on resale, reverse-engineering, and circumventing license verification).
The software may check for and notify you of available updates, and may download and install an update directly when you choose to do so. From time to time, for security reasons or because an older version has become incompatible with the server-side infrastructure the Service depends on, we may designate an update as mandatory; where we do, the software will not be usable again until that update is installed. We do not guarantee that every past version of the software will keep working indefinitely.
8. Intellectual property
We own all rights in the software, the AI models and the Service itself. You retain full ownership of your own photos and of the albums you create with the Service; we do not claim any rights over your content.
9. Acceptable use
You agree to use the Service lawfully and not to use it to process content you don't have the rights to use, or in any way that infringes the rights of others.
10. Service availability
We aim to keep the license-verification server and related online services available, but we don't guarantee uninterrupted availability, and we may perform maintenance or updates that cause temporary downtime.
11. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including in relation to consumer rights.
12. Termination
We may suspend or terminate your account if you materially breach these Terms, including through non-payment or misuse of the license. You may stop using the Service at any time and request the deletion of your account by contacting us at the address in section 16.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will make reasonable efforts to notify active account holders. Continued use of the Service after a change takes effect means you accept the updated Terms.
14. Governing law and jurisdiction
These Terms are governed by Italian law. Any dispute not resolved amicably will be subject to the exclusive jurisdiction of the Court of Lucca, Italy, without prejudice to any mandatory consumer-protection rights you may have under the law of your own country of residence, which nothing in this section limits.
15. Communications
We send you the emails needed to provide the Service (email confirmation, password reset, notices about your account, license, trial, purchases and mandatory updates). These are not promotional and, while you hold an account, you cannot opt out of them. We send promotional emails (news, tips, offers) only if you have ticked the optional consent box at registration or on your account page; you can withdraw your consent at any time from your account page or with the link in every promotional email, with no effect on your use of the Service. See our Privacy Policy.
16. Contact
Questions about these Terms can be sent to info@aialbumstudio.com.
